General Terms and Conditions
§1 Validity towards entrepreneurs and definitions of terms
(1) The following General Terms and Conditions apply to all deliveries between us and a consumer in the version valid at the time of the order.
(2) ‘Consumer’ within the meaning of these General Terms and Conditions is any natural person who concludes a legal transaction for a purpose that cannot be attributed to either their commercial or their independent professional activity.
§2 Conclusion of a contract, storage of the contract text
(1) The following provisions on the conclusion of a contract apply to orders placed via our online shop http://www.polystar-sport.de
(2) If the contract is concluded, the contract is concluded with Ace International Sporting Goods GbR, Dipl.-Kaufmann Michael Nau, Miguel Rodrigo Nau, In den Löser 25
D-64342 Seeheim-Jugenheim, Darmstadt Local Court.
(3) The presentation of the goods in our online shop does not constitute a legally binding contractual offer on our part, but is only a non-binding invitation to the consumer to order goods. By ordering the desired goods, the consumer makes a binding offer to conclude a purchase contract.
(4) Upon receipt of an order in our online shop, the following regulations apply: The consumer submits a binding contractual offer by successfully completing the order procedure provided in our online shop.
The order is placed in the following steps:
1) Selection of the desired goods
2) by clicking on the ‘Add to shopping basket’ button, the goods are transferred to the shopping basket
2a) by repeating point 2, further items can be selected
3) The selected items become visible in the shopping basket
4) Changes can be made by clicking on the ‘Edit shopping basket’ button
5) Confirm by clicking on the ‘Checkout’ button
6) Log in to customer account/create a new customer account
7) View the terms and conditions of sale by clicking on ‘Terms and conditions’
8) Confirm the terms and conditions of sale by ticking the box
9) Select the payment method
10) Select the shipping costs according to the shipping region
11) Place a binding order by clicking on the button ‘Order with obligation to pay’
12) Confirmation of the successful transmission of the order
We confirm receipt of the order immediately by sending an automatically generated e-mail (‘order confirmation’). With this we accept your offer.
(5) Storage of the contract text for orders placed via our online shop: We will send you the order data and our terms and conditions by e-mail. You can also view these at any time at http://www.polystar-sport.de/AGB_de.pdf. For security reasons, your order details are no longer accessible via the Internet.
§3 Prices, shipping costs, payment, due date
(1) The prices quoted include statutory VAT and other price components. Any shipping costs are added.
(2) Within Germany, the consumer incurs shipping costs of €6.99 per order. Payment shall be made by:

We accept your order by sending a declaration of acceptance in a separate e-mail or by delivering the goods within two working days. Invoices are due for payment within 10 days without deduction.
Prepayment:
We will accept your order by sending you a separate e-mail declaration of acceptance within two working days, in which we will provide you with our bank details. If no payment is received within 14 days, the order will be deemed cancelled.
PayPal:
During the ordering process, you will be redirected to the website of the online provider PayPal. There you can enter your payment details and confirm the payment instruction to PayPal. After placing the order in the shop, we request PayPal to initiate the payment transaction and thereby accept your offer. The goods will be dispatched after receipt of payment.
(3) For orders outside Germany, the consumer pays €7.95 shipping costs per order in Europe and €13.50 shipping costs per order outside Europe. Payment shall be made by:
Prepayment: (EU countries, outside the EU)
We will accept your order by sending you a separate e-mail within two working days containing our bank details. If no payment is received within 14 days, the order will be deemed cancelled.
PayPal: (EU countries, USA)
During the ordering process, consumers from EU countries and the USA are redirected to the website of the online provider PayPal. There you can enter your payment details and confirm the payment instruction to PayPal. After placing the order in the shop, we request PayPal to initiate the payment transaction and thereby accept your offer. Payment is only possible via PayPal in EU countries and the USA. The goods will be dispatched after receipt of payment.
§4 Delivery
(1) Unless we have clearly stated otherwise in the product description, all items offered by us are ready for dispatch within 24 hours if they are in stock.
(2) If the consumer has to pay for the goods in advance, we will not dispatch the goods before receipt of payment.
(3) If goods are delivered with obvious transport damage, please complain about such defects to the deliverer as soon as possible and contact us immediately. Failure to make a complaint or contact us has no consequences for your legal claims and their enforcement, in particular your warranty rights. However, you will help us to assert our own claims against the carrier or the transport insurance company.
§5 Retention of title
We reserve title to the goods until the purchase price has been paid in full.
§6 Right of cancellation / Cancellation policy
Right of cancellation:
You can cancel your contractual declaration within 14 days without giving reasons in text form (e.g. letter, fax, e-mail) or - if the goods are delivered to you before the deadline - also by returning the goods. The period begins after receipt of this instruction in text form, but not before receipt of the goods by the recipient (in the case of recurring deliveries of similar goods not before receipt of the first partial delivery) and also not before fulfilment of our information obligations pursuant to Article 246 § 2 in conjunction with § 1 para. 1 and 2 EGBGB and our obligations pursuant to § 312g para. 1 sentence 1 BGB in conjunction with Article 246 § 3 EGBGB. Timely dispatch of the cancellation or the goods is sufficient to comply with the cancellation period.

Consequences of cancellation:
In the event of an effective cancellation, the services received by both parties must be returned and any benefits derived (e.g. interest) surrendered. If you are unable to return or surrender to us the goods or services received and any benefits (e.g. benefits of use), or if you are only able to return or surrender them in part or in a deteriorated condition, you must compensate us for the loss in value. You only have to pay compensation for the deterioration of the item and for the use of the item if the use or deterioration is due to handling of the item that goes beyond checking the properties and functionality. Testing the properties and functionality’ means testing and trying out the respective goods, as is possible and customary in a retail shop, for example. Goods that can be sent by parcel post are to be returned at our risk. You must bear the regular costs of returning the goods if the delivered goods correspond to those ordered. Obligations to refund payments must be fulfilled within 30 days. The period begins for you with the dispatch of your cancellation notice or the goods, for us with their receipt.

The contract language is exclusively German.
